Having followed the recent articles about Phorm (nee 121Media) in the press I was extremely distressed to see the latest news from today about BT running a secret trial

It would appear that BT are in breach of at least these two.

A second related issue around the Phorm advertising is a possible breach of the Copyright, Designs and Patents Act 1988. If BT have replaced the adverts on a site, or injected an advert into a site before presenting it to a user via their browser it may fall foul of the act by modifying the website without permission of the copyright holder.

A short reply was received stating that they were monitoring it closely. He intends to contact the Information Commissioner to see what monitoring has taken place over the course of the last year.
